Effective Date: November 1, 2026
These Terms & Conditions (“Terms”) form a binding agreement between you and Element Home Services (“Element,” “we,” “us,” or “our”), as described under “Who We Are” below. They govern your access to and use of elementhomeservice.com, any page that links to these Terms, and all text, images, video, pricing, offers, tools, forms, and other content made available there (together, the “Site”).
Please read carefully. By accessing or using the Site, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. Section 16 requires most disputes to be resolved through binding individual arbitration and waives your right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days as described in Section 16.
Who We Are
Element Home Services is the brand shared by the four companies below. Each company provides the services offered in its state. In these Terms, “Element,” “we,” “us,” and “our” mean the Element company that serves your location; for the Site itself, they mean each of these companies.
| Location | Company | Doing business as |
|---|---|---|
| Flagstaff, Arizona | Element Home Services AZ, LLC | Element Plumbing Element Plumbing, Heating, Air |
| Durango, Colorado | Element Home Services DU, LLC | Element Plumbing |
| St. George & Hurricane, Utah | Element Home Services STG, LLC | Element Plumbing Element Plumbing, Heating, Air |
| Jackson, Wyoming | Element Plumbing, Inc | Element Plumbing |
Each company’s mailing address is listed in Section 20, and the state law that applies to it is in Section 17.
1. Changes to the Site and These Terms
We may update, suspend, or discontinue any part of the Site, and we may revise these Terms, at any time. Revised Terms take effect when posted with a new Effective Date. Your continued use of the Site after a revision means you accept it. If you do not agree to a revision, your sole remedy is to stop using the Site. Changes to Section 16 will not apply to any dispute of which we had actual notice before the change was posted.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. The Site is not intended for, and may not be used by, anyone under 18. By using the Site, you represent that you meet these requirements.
3. Website Information Is Not a Service Contract
The Site provides general information about our services. Unless we expressly state otherwise in writing:
- Prices, estimates, calculators, and project examples on the Site are illustrative only and are not quotes or binding offers. Actual pricing depends on an on-site evaluation, site conditions, materials, permits, and code requirements.
- Coupons, specials, financing offers, and membership benefits are subject to their own stated terms, may be limited in time or availability, may not be combined unless stated, and may be changed or withdrawn at any time. Offers have no cash value.
- Service areas, availability, and response times are not guaranteed.
- Any work we perform is governed solely by the written estimate, work order, invoice, warranty, or service agreement you sign or accept for that job, not by these Terms. If those documents conflict with these Terms, the job documents control for that work.
Submitting a form, booking request, or message through the Site does not create a service contract or guarantee an appointment until we confirm it.
4. No Professional Advice; Emergencies
Blog posts, FAQs, videos, troubleshooting tips, and other educational content on the Site are general information only. They are not a substitute for an in-person inspection by a licensed professional. Plumbing, gas, electrical, and heating work can be dangerous and may require permits. Any do-it-yourself action you take based on Site content is at your own risk.
The Site is not an emergency service. If you smell gas, suspect a gas leak, carbon monoxide, an electrical fire, or any other immediate danger, leave the area and call 911 and your utility provider. Do not rely on a website form, chat, email, or text for emergencies.
5. Limited License to Use the Site
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to view and use the Site for your personal, non-commercial purpose of learning about and requesting our services. You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, or commercially exploit any part of the Site without our prior written permission. This license ends automatically if you breach these Terms, and you must then destroy any Site content you downloaded or printed.
You are responsible for the devices, software, and internet service you use to access the Site, and for any related charges.
6. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose, or in violation of these Terms;
- Submit false, misleading, or impersonated information, or book appointments you do not intend to keep;
- Post fake, incentivized, or undisclosed paid reviews, or reviews about work you did not receive;
- Harass, threaten, or abuse our staff or other users;
- Use bots, scrapers, crawlers, or other automated means to access, copy, or collect data from the Site, including pricing or contact information, except for search engines indexing public pages in line with our robots.txt file;
- Use Site content or data to train, fine-tune, or build any artificial intelligence or machine learning model;
- Upload viruses, malware, or other harmful code, or attempt to probe, scan, test, or breach the security of the Site;
- Interfere with, overload, or disrupt the Site or the servers and networks behind it;
- Frame or mirror the Site, or use our names or logos in metatags, ads, or search keywords, without our written consent; or
- Help or encourage anyone else to do any of the above.

Our Privacy Policy explains how we handle your mobile information; we do not share text-messaging opt-in data or consent with third parties for their marketing purposes.
8. Content You Submit
If you submit reviews, testimonials, photos, videos, comments, or other content to us or through the Site (“User Content”), you are solely responsible for it. You represent that you own or have permission to share it, that it is truthful and lawful, that it does not infringe anyone’s rights or include anyone’s private information without consent, and that it is not defamatory, obscene, harassing, or misleading.
You grant Element a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, edit, adapt, publish, display, and distribute your User Content, and the name, city, and likeness you include with it, in any media, including in advertising and marketing, without further notice or compensation. You waive any moral rights in your User Content to the extent permitted by law.
We may review, edit, decline, or remove User Content at any time for any reason, but we have no obligation to monitor it. We are not responsible for User Content posted by others or for any loss of content you submit.
9. Feedback
Any suggestions, ideas, or feedback you send us about the Site or our services are non-confidential. We may use them for any purpose without restriction, attribution, or compensation to you.
10. Our Intellectual Property
The Site and all of its content, design, software, and compilation, along with the names Element, Element Home Services, Element Plumbing, and Element Plumbing, Heating, Air, the names of the Element companies, our logos, and our slogans, are owned by or licensed to us and are protected by copyright, trademark, and other laws. All rights not expressly granted in these Terms are reserved. You may not use our names, logos, or trademarks without our prior written consent. Other trademarks shown on the Site, such as equipment manufacturer brands, belong to their owners and do not imply endorsement.
11. Copyright Complaints
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). To submit a notice, send our designated agent a written notice that includes:
- Your physical or electronic signature;
- Identification of the copyrighted work you believe is infringed;
- Identification of the material you claim is infringing and where it appears on the Site, with enough detail for us to find it;
- Your name, address, phone number, and email address;
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.
Designated agent: Copyright Agent, Element Home Services STG, LLC, 1240 E 100 S, Suite 201E, St. George, UT 84790, privacy@elementhomeservice.com.
If your content was removed and you believe it was removed by mistake, you may send a counter-notice containing the information required by 17 U.S.C. § 512(g)(3). We may remove content and terminate access for repeat infringers. Knowingly false notices may expose you to liability for damages.
12. Privacy
Our Privacy Policy explains how we collect, use, and share personal information and is incorporated into these Terms.
13. Third-Party Links and Services
The Site may link to or include features from third parties, such as financing providers, booking and payment tools, review platforms, maps, manufacturers, and social media. We do not control and are not responsible for their content, products, services, availability, security, or privacy practices, and a link does not mean we endorse them. Your use of any third-party service is governed by that party’s terms and is at your own risk. Any financing or credit decision is made solely by the lender.
14. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES, OR THAT PRICES, OFFERS, OR OTHER INFORMATION ON THE SITE ARE COMPLETE, CURRENT, OR ACCURATE. WE MAY CORRECT ERRORS, INCLUDING PRICING ERRORS, AT ANY TIME.
This disclaimer applies to the Site only. Warranties for work we perform or products we install, if any, are stated solely in your job documents and in manufacturer warranties.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ELEMENT AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
These limits apply to claims about the Site. They do not limit liability for work we perform, which is governed by your job documents, and they do not apply where the law does not allow such limits, including for gross negligence, willful misconduct, or personal injury caused by our negligence.
Indemnification. You agree to defend, indemnify, and hold harmless Element and its owners, officers, employees, agents, and contractors from any claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your User Content, your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right. We may assume the exclusive defense of any matter you must indemnify, and you will cooperate with our defense.
16. Dispute Resolution, Binding Arbitration, and Class Action Waiver
Informal resolution first. Before starting arbitration or a lawsuit, the party with a claim must send the other a written notice describing the claim and the relief sought. Notices to us go to privacy@elementhomeservice.com and to the mailing address in Section 20 of the Element company that serves your location. Each notice must be individual and signed by the person bringing the claim. For 60 days after the notice is received, the parties will try in good faith to resolve the dispute, including by phone or video conference if either requests one. Any deadline to bring the claim is paused during this period.
Agreement to arbitrate. If the dispute is not resolved, you and Element agree that any dispute, claim, or controversy arising out of or relating to the Site or these Terms, including their formation, scope, or enforceability, will be resolved by binding individual arbitration. The Federal Arbitration Act governs this Section. Arbitration will take place in the county where you live or by phone or video, and claims under $10,000 may be decided on written submissions. The arbitrator’s decision is final and may be entered in any court with jurisdiction. Arbitration fees will be allocated as required by applicable law.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to stop actual or threatened infringement or misuse of intellectual property or unauthorized access to the Site.
Class action and jury trial waiver. YOU AND ELEMENT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND ELEMENT EACH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may award relief only to the individual claimant and only to the extent needed for that claim. If this class action waiver is found unenforceable as to any claim, that claim will be decided in court, not arbitration, and will be stayed until any individual arbitration is complete.
Mass filings. If 25 or more similar arbitration demands are filed against us by or with the help of the same or coordinated counsel, the demands will be administered in batches, and the parties will mediate in good faith before further batches proceed. Any deadline to bring a claim is paused while a demand awaits its batch.
30-day opt-out. You may opt out of this agreement to arbitrate by sending a signed letter to the Element company that serves your location, at its mailing address in Section 20, within 30 days after you first agree to these Terms. The letter must include your full name, mailing address, email address, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms.
Time limit to bring claims. To the extent permitted by law, any claim arising out of or relating to the Site or these Terms must be brought within one (1) year after it arises, or it is permanently barred.
Severability. If any part of this Section 16 other than the class action waiver is found unenforceable, the rest of this Section remains in effect.
17. Governing Law and Venue
These Terms are governed by the Federal Arbitration Act, applicable federal law, and the laws of the state listed below for the Element company that serves your location, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any claim not subject to arbitration must be brought exclusively in the state courts for the county listed below or in the United States District Court for that state, and you consent to the personal jurisdiction of those courts.
- Flagstaff, AZ (Element Home Services AZ, LLC): Arizona law; Coconino County, Arizona.
- Durango, CO (Element Home Services DU, LLC): Colorado law; La Plata County, Colorado.
- St. George & Hurricane, UT (Element Home Services STG, LLC): Utah law; Washington County, Utah.
- Jackson, WY (Element Plumbing, Inc): Wyoming law; Teton County, Wyoming.
A claim that does not relate to a particular location is governed by Utah law and venued in Washington County, Utah. The Site is operated from the United States and is intended for people in the United States; if you access it from elsewhere, you are responsible for complying with local law.
18. Suspension and Termination
We may suspend or end your access to all or part of the Site at any time, without notice or liability, for any reason, including if we believe you have violated these Terms. Sections 6, 8 through 11, and 13 through 19 survive any termination.
19. General Terms
Entire agreement. These Terms, together with our Privacy Policy and any terms posted for a specific offer or feature, are the entire agreement between you and us about the Site and replace any prior understandings about it.
Severability. If a court or arbitrator finds any provision unenforceable, that provision will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms without our written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, utility or internet outages, labor shortages, supply chain disruptions, government orders, or public health emergencies.
Notices. We may give you notice by email, by text if you opted in, or by posting on the Site. Legal notices to us must be sent to privacy@elementhomeservice.com and to the mailing address in Section 20 of the Element company that serves your location.
Headings. Section headings are for convenience only and have no legal effect. The word “including” means “including without limitation.”
Licensing. The Element companies hold these licenses: Arizona Registrar of Contractors ROC 362018; Colorado Plumbing Contractor PC.0004697 and Master Plumber MP.03001859; Utah Contractor 13980506-5501; and Wyoming CL-25-0130.
