1. Scope of This Policy
This Policy covers personal information we handle online and offline in connection with our “Services,” which means:
- Our website(s), including elementhomeservice.com, and any page that links to this Policy;
- Phone calls, emails, text messages, live chat, and online booking with our team;
- Estimates, inspections, installations, repairs, maintenance plans, memberships, and financing inquiries;
- Promotions, giveaways, surveys, reviews, and events we sponsor or run; and
- Dealings with vendors, subcontractors, referral partners, and other business contacts.
What this Policy does not cover. This Policy does not apply to information about our job applicants, employees, or independent contractors acting in that role; those individuals receive separate notices. It also does not apply to third-party websites, apps, or platforms, even if we link to them or advertise on them.
Supplemental notices. We may give you a more specific notice for a particular program, such as financing or a membership plan. Where that notice conflicts with this Policy, the supplemental notice controls for the information it covers.
2. Information We Collect
The information we collect depends on how you interact with us. We collect it from you, from outside sources, and automatically when you use our website. Where the law allows, we may combine information from these sources.
Information you give us
- Contact and identity details: name, phone number, email, and the address where service is requested.
- Service and property details: the problem you describe, photos or videos you send, notes about your home or equipment, access instructions, gate or lockbox details you choose to share, and the history of work performed.
- Transaction details: quotes, invoices, payment method type, billing address, and financing or membership inquiries. Card numbers are entered into, and stored by, our third-party payment processors; we do not keep full card numbers on our own systems.
- Communications: messages, form submissions, chat transcripts, reviews, testimonials, survey answers, and your communication preferences.
- Business contact details: for vendors, subcontractors, and partners, a name, company, title, and work contact information.
Call recordings. Calls with our office may be recorded and transcribed for quality, training, dispute-resolution, and record-keeping purposes. Where required, we will tell you at the start of the call. By staying on the line after that notice, you consent to the recording.
Information from other sources
- Lead-generation and home-services marketplaces that send us your request;
- Advertising, analytics, and social media platforms (for example, when you submit a lead form inside an ad or interact with our page);
- Manufacturers, warranty providers, financing partners, and property managers involved in your job; and
- Public records and data providers we use to verify, update, or enrich our records.
We are not responsible for the accuracy of information supplied to us by third parties, and you may ask us to correct it as described in Section 9.
Information collected automatically
- Device and connection data: IP address, browser and operating system, device identifiers, language, and internet provider.
- Usage data: pages viewed, links clicked, referring and exit pages, time on site, form interactions, and similar clickstream information.
- Approximate location: derived from your IP address. We collect precise device location only with your permission.
See Section 6 for more on cookies and similar technologies.
Information you should not send us. Please do not send us Social Security numbers, government ID numbers, health information, passwords, or full financial account numbers through our website, email, or text. If you do, you accept the risk of sending it through an unsecured channel.
3. How We Use Information
We use personal information to run our business and serve you, including to:
- Schedule, dispatch, perform, invoice, and follow up on service;
- Answer questions, provide estimates, and send appointment reminders and job updates;
- Process payments, financing applications, warranties, and membership benefits;
- Send newsletters, offers, and promotions you have agreed to receive;
- Measure and improve our website, advertising, and customer experience;
- Build audiences and measure ad performance on third-party platforms (see Section 6);
- Conduct surveys and request reviews;
- Train staff and monitor service quality;
- Detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;
- Enforce our agreements and protect the rights, property, and safety of Element, our team, our customers, and the public;
- Keep business, tax, and accounting records and comply with legal obligations, court orders, and lawful requests; and
- Evaluate or complete a financing, merger, sale, reorganization, or similar transaction.
We may also use information for any other purpose we describe when we collect it, or with your consent.
4. How We Disclose Information
We do not sell your personal information for money. We do not share mobile phone numbers or text-messaging opt-in data and consent with third parties or affiliates for their own marketing or promotional purposes. The categories below exclude text-messaging originator opt-in data and consent.
We may disclose personal information to:
- Service providers who work on our behalf under contractual confidentiality obligations, such as scheduling and dispatch software, web hosting, payment processing, call tracking, email and SMS delivery, customer support, accounting, IT security, and professional advisors.
- Job partners needed to complete your service, such as subcontractors, equipment manufacturers, warranty administrators, permitting authorities, and financing companies you choose to apply with.
- The other Element companies listed above, and any other affiliated companies under common ownership or control.
- Advertising and analytics partners that receive device, browsing, and usage data, or hashed contact lists, to measure and deliver ads (see Section 6).
- A successor or acquirer in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets. Information may be transferred as part of that transaction.
- Government agencies, courts, and others when we believe in good faith that disclosure is required by law or legal process, or reasonably necessary to protect rights, property, or safety, or to investigate fraud.
- Anyone you direct us to share with, or with your consent.
We may freely use and share information that has been aggregated or de-identified so that it no longer reasonably identifies you. We will not attempt to re-identify de-identified data except as permitted by law.
5. Text Messaging (SMS/MMS) Program
Consent. By providing your mobile number and opting in (for example, by checking a box, submitting a form that says you will receive texts, or texting us first), you agree to receive text messages from Element at that number, including messages sent with automated technology. Consent is not a condition of purchasing any goods or services.
Message types. Texts may include replies to your inquiries, estimates and quotes, appointment scheduling, confirmations and reminders, technician arrival notices, job updates, payment and invoice notices, review or feedback requests, and, if you have agreed, promotional offers.
Frequency. Message frequency varies with your service activity.
Cost. Message and data rates may apply, both for messages we send and messages you send us. Contact your wireless carrier about your plan.
Opt out. Reply STOP at any time to stop receiving texts. We will send one final message confirming you have been unsubscribed. To re-enroll, reply START or opt in again the way you did originally.
Help. Reply HELP for assistance, call (435) 268-1342, or visit our contact page.
Your responsibilities. You confirm that you are the account holder or authorized user of the mobile number you provide. Please notify us promptly if you change or give up that number.
Delivery. Wireless carriers are not liable for delayed or undelivered messages. We do not guarantee delivery or timing of any text, and texts should not be relied on for urgent or emergency communications.
6. Cookies, Tracking, and Advertising
We and our partners use cookies, pixels (web beacons), tags, software development kits, local storage, and server logs to operate the website, remember preferences, keep the site secure, understand traffic, attribute leads and calls to ad campaigns, and show relevant ads.
- Cookies are small data files placed in your browser.
- Pixels and tags are snippets of code that report page visits and actions, such as a form submission, to us or a partner.
- Local storage keeps data in your browser after you close the window.
- Call tracking may assign a unique phone number to a visit or ad so we can tell which marketing produced a call.
Analytics. We use analytics services, such as Google Analytics, that collect usage data through their own cookies. Google explains its practices at google.com/policies/privacy/partners and offers an opt-out add-on at tools.google.com/dlpage/gaoptout.
Advertising. We work with advertising platforms, such as search, social media, and display networks, that may use these technologies to show you our ads on other sites and to measure results. Those platforms may link activity across the devices and browsers you use.
Customer lists. We may upload contact details, typically in hashed (scrambled) form, to advertising platforms to match existing or prospective customers and to find similar audiences.
Third parties’ use of these technologies is governed by their own privacy policies, not this one.
7. Your Choices
- Marketing email: use the unsubscribe link in any marketing email. We may still send transactional messages about your service, account, or payments.
- Text messages: reply STOP, as described in Section 5.
- Cookies: most browsers let you block, delete, or be alerted to cookies. Blocking some cookies may affect how the website works.
- Interest-based ads: opt out of participating ad networks at optout.aboutads.info and adjust ad settings within the platforms you use.
- Opt-out preference signals: where state law requires, we treat a recognized signal such as Global Privacy Control (GPC) as a request to opt out of sale, sharing, or targeted advertising for that browser. You can also contact us as described in Section 9.
- Do Not Track: because no uniform standard exists, our website does not respond to browser “Do Not Track” signals.
Opt-outs set through cookies or browser signals apply only to the browser and device on which they are set and may be lost if you clear cookies.
8. Retention, Security, Children, and Outside Links
Retention. We keep personal information for as long as reasonably necessary for the purposes in this Policy, including to honor warranties, maintain service history for your property, resolve disputes, enforce agreements, and meet tax, licensing, and other legal record-keeping requirements. When information is no longer needed, we delete, de-identify, or securely archive it. We may keep information longer when a legal hold, investigation, or claim requires it.
Security. We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, use, or disclosure. However, no website, network, or storage system is completely secure, and we cannot guarantee the security of any information you transmit or that we store. You share information at your own risk, and you are responsible for keeping any passwords or account access you hold confidential. If we learn of a security incident affecting your personal information, we will notify you as required by applicable law.
Children. Our Services are intended for adults and are not directed to children under 16. We do not knowingly collect personal information from children under 13, or sell or share information of anyone we know to be under 16. If you believe a child has given us personal information, contact us and we will take reasonable steps to delete it.
Outside links and platforms. Our Services may link to or integrate with third-party websites, booking tools, financing portals, review sites, maps, and social media. We do not control and are not responsible for the content, security, or privacy practices of those third parties. Please review their policies before giving them information.
9. Privacy Rights for U.S. State Residents
Depending on where you live, and subject to the thresholds, exceptions, and limits in your state’s law, you may have the right to:
- Know and access whether we process your personal information and obtain a copy of it;
- Portability, meaning a copy of information you gave us in a commonly used, machine-readable format where technically feasible;
- Correct inaccurate personal information;
- Delete personal information we hold about you;
- Opt out of the sale of personal information, targeted advertising, and profiling that produces legal or similarly significant effects; and
- Not be discriminated against for exercising these rights.
We do not use personal information for profiling that produces legal or similarly significant effects. We do not exchange personal information for money. However, our use of advertising cookies, pixels, and customer-list matching may be considered a “sale” or “targeted advertising” under some state laws. The categories involved are identifiers (such as IP address, cookie IDs, and hashed contact details) and internet activity (such as browsing and usage data).
How to submit a request. Email privacy@elementhomeservice.com, call (435) 268-1342, or write to us at the address in Section 12. To opt out of sale or targeted advertising, you can also adjust cookie settings or enable GPC (see Section 7).
Verification. To protect you, we will verify your identity before fulfilling access, portability, correction, or deletion requests, typically by matching information you provide to our records. We may ask for more information if needed. We may decline a request if we cannot verify it, if it is manifestly unfounded or excessive, or if an exception applies, such as information we must keep for legal, warranty, tax, safety, or dispute-related reasons. Deleting information may limit our ability to provide future service or honor warranties.
Authorized agents. You may use an authorized agent where state law permits. The agent must provide written proof of authority, and we may ask you to verify your identity directly.
Timing and appeals. We will respond within the time your state’s law requires. If we deny your request, we will explain why. You may appeal by replying to our decision or emailing privacy@elementhomeservice.com with the subject line “Privacy Appeal.” If your appeal is denied, you may contact your state attorney general.
10. Limitations, Disputes, and Governing Law
No contract created. This Policy describes our practices; it does not create contractual rights for any person beyond those required by law.
Limitation of liability. To the fullest extent permitted by law, Element and its owners, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to this Policy or the handling of your personal information, including unauthorized access caused by third parties beyond our reasonable control. Any liability we do have is subject to the limits in our Terms & Conditions. Nothing in this Policy limits liability that cannot be limited under applicable law.
Disputes. Any dispute about this Policy or our privacy practices is subject to the dispute-resolution provisions of our Terms & Conditions, including binding individual arbitration and a waiver of class actions. Before filing any claim, you agree to first contact us at privacy@elementhomeservice.com and give us 30 days to try to resolve the issue informally.
Governing law. This Policy is governed by the laws of the state that governs our Terms & Conditions for your location (Section 17 of those Terms), without regard to conflict-of-law rules, except where the privacy law of your state of residence applies by its own terms. Subject to the Terms & Conditions, any court action shall be brought in the courts named in that section.
U.S. operations. Our Services are intended for people in the United States. Information is stored and processed in the United States, and by using the Services you consent to that.
Severability. If any part of this Policy is found unenforceable, the remainder stays in full effect.
11. Changes to This Policy
We may update this Policy from time to time. The “Effective Date” at the top shows when it was last revised, and the updated version takes effect when posted. If we make a material change to how we use or disclose personal information we have already collected, we will give notice by posting a prominent notice on our website or contacting you directly, and will obtain consent where the law requires. Your continued use of the Services after an update means you accept the revised Policy.
